Account Terms
You must be at least eighteen (18) years old to access or use Tunehood. By using the platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.
You are responsible for the accuracy of the information you provide. If you gain access to Tunehood by providing false information, including misrepresenting your age, you assume full responsibility for any consequences arising from that access. Tunehood is not liable for any harm resulting from unauthorized access obtained through misrepresentation.
Your account is your responsibility, but Tunehood keeps your exposure minimal. Tunehood does not store passwords or payment information. Access is tied to your email and mobile number, so keep both secure. If you think someone else has accessed your account, contact Tunehood right away.
One mobile number, one vote. For the Tunehood Awards, voting requires a verified mobile number. Each phone number counts as one vote, regardless of how many accounts are associated with it.
Marketing preferences are set during registration and can be updated at any time. When you create an account, Tunehood will present you with options to choose the types of communications you receive. Email marketing communications are enabled by default and can be turned off at any time. SMS marketing communications require your explicit opt-in and are never enabled without your affirmative consent.
By registering, you consent to receive communications from Tunehood. This includes transactional messages such as login verification codes and account notices, as well as marketing communications such as show recommendations and platform updates. Standard message and data rates may apply for SMS messages.
Opting out of marketing communications is straightforward and immediate. To stop marketing emails, click the unsubscribe link in any marketing email from Tunehood. Email unsubscribe requests will be processed within 10 business days as required by law. To stop marketing text messages, reply STOP to any text message from Tunehood. SMS opt out requests are processed within 24 hours. Opting out of marketing communications does not affect transactional messages, which are required for account security and cannot be disabled while your account is active. If you believe you have received communications from Tunehood after opting out, contact Tunehood immediately at tunehood.tampa@gmail.com.
The Platform
Tunehood is a music discovery platform, not a ticketing company. Tunehood curates show listings, connects you to local artists, and helps you find live music near you. When you click a ticket link, you're leaving Tunehood and heading to a third-party site like Ticketmaster, StubHub, or SeatGeek. Tunehood does not control and is not responsible for third-party websites or services, including ticketing platforms. Your interactions with such third parties are solely between you and the third party and are governed by their terms and policies.
Show info can change, so always verify before you go. Tunehood pulls data from multiple sources and is constantly monitoring data sources to update listings as soon as possible, but dates, times, venues, lineups, and ticket availability can change without notice. Tunehood makes no guarantee that any listing is accurate at the time you view it.
Do not make non-refundable travel, lodging, or ticket purchases based solely on information found on Tunehood. Always confirm show details directly with the venue or artist before making any financial commitment. Tunehood is not responsible for any costs, losses, or damages, including travel expenses, lodging costs, ticket purchases, or any other out of pocket expenses incurred in reliance on information displayed on the platform, regardless of whether Tunehood was aware the information was inaccurate.
Tunehood may display advertising and include sponsored content within its platform and communications. Every placement is curated by Tunehood and chosen for its relevance to you and your local music scene. Advertisers never receive your personal information or contact you directly. You can update your communication preferences at any time through your account settings.
Tunehood uses automated tools, including artificial intelligence, to enhance platform functionality and recommendations. To the extent personal data is processed through such tools, Tunehood implements reasonable measures to limit the use of personally identifiable information. Tunehood does not intentionally use personal information to train third-party artificial intelligence models.
This platform is for humans only. Automated bots, scrapers, crawlers, and AI agents are not authorized to access any part of Tunehood that requires a login. Public pages may be indexed by search engines, but anything behind an account is off limits to non-human traffic of any kind. Unauthorized automated access is a violation of these terms and may be pursued legally.
Platform Rules
There are a few things you can't do here. When you use Tunehood, you agree not to post false or misleading content, harass or spam other users, scrape or copy the platform, or submit fake show or artist information. Tunehood reserves the right to remove content or suspend accounts that break these rules.
Tunehood is a platform, not a publisher. Tunehood does not guarantee the accuracy of user-submitted content and is not responsible for content submitted by users. Tunehood reserves the right to remove, edit, or reject any content at its sole discretion, with or without notice, and without liability to the user who submitted it. Moderation decisions are made to protect the integrity of the platform and its community. Tunehood is an interactive computer service provider and is entitled to the protections afforded under Communications Decency Act Section 230. Tunehood is not liable for content provided by users or third parties.
Tunehood reserves the right to suspend or permanently terminate any account at any time. Tunehood may do so with or without notice for violations of these Terms, conduct that Tunehood reasonably believes is harmful to the platform, its users, artists, or venues, or for any other legitimate business reason. Tunehood does not terminate accounts on the basis of race, religion, national origin, gender, sexual orientation, disability, or any other protected characteristic. Terminated accounts are not entitled to reinstatement.
Your Content
You retain ownership of any content you submit to the platform. By submitting content, you grant Tunehood a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from such content in connection with operating, improving, and promoting the platform. This license survives termination of your account.
Content you submit to the platform may remain publicly available after account deletion. When you submit a show, artist, or venue to Tunehood, that content becomes part of the platform's public database. Deleting your account removes your personal information but does not automatically remove content you contributed to the platform. If you want specific submitted content removed, contact Tunehood at tunehood.tampa@gmail.com before deleting your account.
Everything Tunehood built belongs to Tunehood. The platform, design, and curation are Tunehood's. Please don't copy them.
Tunehood respects intellectual property rights. If you believe content on Tunehood infringes your copyright, you may submit a takedown request to Tunehood's designated copyright agent at tunehood.tampa@gmail.com. Your request must include a description of the copyrighted work, the location of the infringing content on Tunehood, your contact information, and a statement that you have a good faith belief the use is unauthorized. Tunehood will respond promptly and remove infringing content where appropriate.
Payments & Membership
Premium memberships renew automatically until you cancel. You can cancel your membership anytime in your account settings and your access will continue through the end of your current billing period.
Your payment data never touches Tunehood's servers. Tunehood processes payments through trusted third-party providers including Stripe, Apple Pay, Google Pay, and PayPal. Tunehood does not store your payment information.
Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Tunehood makes no guarantees, express or implied, that the platform will be uninterrupted, error-free, or that any specific show listing will be accurate or current at the time you view it. Tunehood's service is limited to aggregating and presenting publicly available information about live music events. Tunehood does not warrant that this information is complete, reliable, or fit for any particular purpose. Paid membership provides access to platform features, not a guarantee of any specific content or show information.
Tunehood's liability to you is strictly limited. To the fullest extent permitted by Florida law, Tunehood's total liability to you for any claim arising from your use of this platform is limited to the amount you paid Tunehood in the 12 months prior to the claim, or $100, whichever is greater. If you are a free user, Tunehood's maximum liability is $100. The limitations set forth in this section apply to all claims, whether based in contract, tort, strict liability, or any other legal theory.
Tunehood is not liable for any indirect, consequential, incidental, punitive, or special damages, or for any lost profits, lost data, or loss of goodwill, even if Tunehood was advised that such damages were possible. This applies to any claim arising from your use of the platform, third-party errors, show cancellations, or information that changes after Tunehood publishes it.
You agree to defend, indemnify, and hold harmless Tunehood and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your infringement of any third-party rights. This obligation does not apply to the extent caused by Tunehood's gross negligence or willful misconduct.
Disputes & Legal
Disputes start with a conversation, not a lawsuit. Before filing any legal claim against Tunehood, you must submit a written notice of dispute to tunehood.tampa@gmail.com with the subject line "Notice of Dispute." Your notice must include your name, the email address associated with your account, a description of the dispute, and the resolution you are seeking. Tunehood will have 30 days from receipt of a complete notice to respond and attempt resolution. If the dispute is not resolved within 30 days of Tunehood's receipt of your notice, either party may pursue the matter in accordance with the governing law and venue described below. Any legal claim must be filed within two (2) years after the claim arises, or it will be permanently barred.
The losing party pays the winner's legal costs. In any action, suit, arbitration, mediation, bankruptcy proceeding, administrative proceeding, or other legal or equitable proceeding arising out of or relating to these Terms or your use of Tunehood, the prevailing party is entitled to recover from the non-prevailing party all reasonable attorneys' fees and costs, including fees and costs incurred before suit, at trial, on appeal, in bankruptcy proceedings, in post-judgment enforcement, and in any collection, workout, restructuring, or settlement efforts, whether or not litigation is commenced.
WAIVER OF JURY TRIAL. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND TUNEHOOD EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM.
Florida law governs these terms. These Terms of Use and anything arising from your use of Tunehood are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any legal disputes will be handled exclusively in the state courts of Pinellas County, Florida, or if federal jurisdiction applies, in the United States District Court for the Middle District of Florida, Tampa Division. By using this site, you agree to that jurisdiction and waive any objection to it.
General
If any part of these Terms is found unenforceable, the rest still stands. A court finding any provision invalid or unenforceable will not affect the remaining provisions, which will continue in full force and effect.
These Terms are the complete agreement between you and Tunehood. They supersede any prior communications, representations, or agreements, whether written or verbal, relating to your use of the platform. No statement made by Tunehood in any email, social media post, or other communication constitutes a modification of these Terms unless it is posted as an updated version of this document.
These terms can change, and Tunehood will notify you when they do. Tunehood reserves the right to modify these Terms at any time, subject to applicable law and notice requirements. The last updated date at the top of this page always reflects the current version. Continuing to use Tunehood after an update means you accept the new terms.
When you delete your account, a confirmation screen will ask you to acknowledge your agreement to these Terms. That confirmation is logged as part of Tunehood's minimal legal records as described in the Privacy Policy.
Assignment. Tunehood can transfer these Terms; you cannot. Tunehood may assign or transfer these Terms, in whole or in part, without restriction. You may not assign your rights or obligations without prior written consent from Tunehood.
Force Majeure. Tunehood is not responsible for circumstances beyond its control. Tunehood shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, internet outages, or governmental actions.
Privacy
Your use of Tunehood is also governed by Tunehood's Privacy Policy. By using this platform you agree to the collection and use of your information as described in Tunehood's Privacy Policy.
